ICE fishing

When President Trump visited North Carolina he assured our state that the federal checkbook would be opened and that we would get almost anything we wanted from FEMA, the Federal Emergency Management Agency. We’re pretty good at spotting political hyperbole, but still hope these promises are fulfilled. There is pause for concern after we learned that FEMA recently transferred $10 million in funds designated for emergency response to ICE (Immigrations and Customs Enforcement). FEMA officials denied that disaster response money was transferred.  

But FEMA wasn’t the only program moving funds to ICE. NBC News reports that some $169 million has been transferred, including $29 million from the U.S. Coast Guard and more than $34 million from several TSA programs. Why so much money, why now and for what purpose?

We don’t much believe in coincidence, especially when evidence suggests otherwise. Let’s begin with the 19 indictments handed down in Wilmington of foreign nationals who allegedly voted illegally in the 2016 NC elections. Days later, the Justice Department subpoenaed, on behalf of ICE, as many as 20 million documents from state and 44 local election boards, going back as far as eight years.  These election boards were flabbergasted, coming so near the November elections. ICE didn’t explain why they wanted the records, what they were looking for or why they issued subpoenas from mostly eastern counties.  

Our State Board of Elections protested not only the timing, but also the motive behind these subpoenas. DOJ relented and delayed the deadline for responding until January. The elections board also requested that our Attorney General file a motion to quash the subpoenas altogether. Speaking for the Board, Vice Chair Joshua Malcolm said the requests were “overly broad, unreasonable, vague, and clearly impacts significant interests of our voters.” Historically whenever there was any indication of past voting impropriety, he explained, the State Board has initiated a request to the U.S Attorney’s office for investigation and stands ready now to assist in an investigation if there is sufficient reason. 

Gerry Cohen, for many years legal counsel to our legislature, called this a “fishing expedition.” There might be some justification for such an unprecedented request if we were given some indication of potential fraud or irregular voting procedures, however an ICE spokesman said he couldn’t comment on an ongoing federal investigation.

We don’t want anyone who is not supposed to vote casting ballots in our elections, however a pretty extensive study of the 2016 election - instigated by our Republican governor and legislature and conducted by our elections board - found only 500 ineligible votes cast from among 4.8 million statewide ballots. That’s not significant enough to influence any election or cause great concern.

We are left to form our own conclusions, and we conclude this is part of an ongoing political agenda from an administration that has made it clear it doesn’t like immigrants. Further, these subpoenas were filed in Eastern Carolina because the president has a large base of support there. 

If ICE can substantiate the need for further investigation, perhaps a test of records in a small number of counties could prove or disprove the justification for more. But not in 44 counties all at once.

Absent further evidence this is nothing more than a politically motivated ICE fishing expedition.

Excellent commentary Tom. There are those who would turn ICE into a gestapo like organization. It is incumbent on voters to read what you and others who have looked into it have found and written. Immigration remains a problem mired in self serving politics and bigotry and it desperately needs reform - not walls and quotas and attacks on family structure. We have always had immigration and we have always had NIMBYs, but except for the Chinese Exclusion Acts of the 1860s there were no laws preventing immigration until 1922...since then we have succumbed periodically to isolationists and each time it hurts more than it helps. Everyone being educated then voting is what will keep us straight. BTW violating immigration law is still a misdemeanor not a felony.

The first time being apprehended in the US without authorization is a misdemeanor, each time after that is a felony.

The study did not verify the oath of citizenship on the voter registration form that the State and County does not verify as a matter of the voter registration process. So the study would not find non citizen's illegally registered and illegally voting. The study did not have verification that the person voting was the registered voter they claim to be since no verification is performed at the polling place other than asking for the name and address of a registered voter where the State provides anyone access to a website with the name, address, polling location, party affiliation, and voting history of all registered voters in the State.

The problem is who do you choose to believe.

How many times now has NBC as well as other big time news agencies

been discovered to have dreamed up the news and or twisted it

to suite their own political view.

What we need are legislators who will push for what we need in

relief. In my view there is where we are lacking. Where is our government

legislators.

I know where, playing politics, that's where.
